Federal Judge Mandates Freedom of Abrego Garcia from Immigration Custody

Courtroom scene

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a erroneous removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was detained in federal detention.

In her decision, the court noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Case

The court proceedings involve conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in Tennessee.

Terms of Release

The judge, who was overseeing his challenge to deportation in a federal court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.

This decision marks a notable turn in a complicated immigration battle featuring allegations of wrongful detention and disputed gang affiliations.
